QR Boom Terms of Service

Welcome to QR Boom. By accessing or using our website, applications, and services (collectively, the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Services

QR Boom provides tools for creating, hosting, and managing QR codes and associated content, together with related analytics and account features. We may modify, suspend, or discontinue parts of the Service at any time.

2. Accounts & Authentication

To use certain features you must create an account. You may create an account using email/password or via third-party authentication providers such as Google, Facebook, and GitHub ("OAuth Providers"). When you register using an OAuth Provider we receive certain profile information (such as name and email) from that provider according to the provider's permissions you authorize.

You are responsible for the activity that occurs on your account. Keep your account credentials secure and promptly notify us of any unauthorized use.

3. Payments, Billing, and Subscriptions

Some features are billed. By purchasing a paid plan or other paid feature, you agree to pay the fees in accordance with the pricing and billing terms presented to you. We use third-party payment processors (for example Stripe) to handle payments. Your payment information is handled by the processor and not stored by us.

Unless otherwise stated, fees are non-refundable. Promotional credits, free trials, or discounts may be subject to additional terms. We may change prices for future billing cycles but will not change fees for an active billing period without notice.

4. User Content and Responsibility

You are solely responsible for any content you upload, link to, embed in, or transmit through QR Boom ("User Content"). User Content must comply with applicable laws and these Terms. You represent and warrant that you have all rights necessary to provide the User Content and grant the licenses described in our Privacy Policy.

5. QR Codes and Linked Content — No Endorsement

The Service lets you create and publish QR codes that link to URLs, files, or other content. We do not control or endorse the content linked by QR codes. You acknowledge that QR codes created or hosted via the Service may direct users to content provided by you or third parties and may change over time.

If you enable analytics for a QR code, the Service may generate a scan link (also referred to as a short link) that redirects to the destination you configured. Scan links (short links) and analytics are provided to help you measure usage; you are responsible for the content and destinations associated with any QR code or scan link you create. We are not responsible for third-party content reachable through QR codes or scan links, and we disclaim liability for damages arising from such content to the extent permitted by law.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QR BOOM IS NOT RESPONSIBLE FOR ANY LOSS, DAMAGE, OR LIABILITY ARISING FROM OR RELATED TO USER CONTENT, THE CONTENT LINKED TO OR EMBEDDED IN QR CODES, OR USE OF QR CODES BY THIRD PARTIES. This includes, without limitation, any damage resulting from malware, fraudulent content, illegal material, or messages that may be induced by scanning a QR code.

6. Disclaimers; No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Accessibility

We strive to make QR Boom accessible to as many users as possible and follow recognized accessibility best-practices and automated checks (including Lighthouse audits) to improve usability for people with disabilities. Despite our efforts, we cannot guarantee the Service will be fully accessible in all circumstances or on all devices. If you experience an accessibility barrier, please contact us at[email protected] and we will make reasonable efforts to provide an alternative or a workaround.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, QR BOOM IS NOT LIABLE FOR ANY INABILITY TO ACCESS OR USE THE SERVICE DUE TO ACCESSIBILITY LIMITATIONS OR FAILURES TO MEET AUTOMATED ACCESSIBILITY CHECKS.

7. Limitation of Liability

TO THE EXTENT PERMITTED BY LAW, IN NO EVENT WILL QR BOOM, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS OR SUPPLIERS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO QR BOOM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS (USD 100), WHICHEVER IS GREATER.

8. Indemnification

You agree to defend, indemnify, and hold harmless QR Boom and its affiliates from any claims, liabilities, losses, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your breach of these Terms, your User Content, or your violation of any law or the rights of any third party.

9. Termination

We may suspend or terminate your access to the Service at any time for conduct that we believe violates these Terms or is harmful to other users, third parties, or us. Upon termination, your right to use the Service will immediately cease. We may delete or retain your User Content as required by law or our policies.

10. Changes to the Terms

We may revise these Terms from time to time. We will provide notice of material changes where required by law (for example by email or by posting a notice on the Service). Continued use after notice constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction where QR Boom is located, without regard to conflict of law principles. You agree to the exclusive jurisdiction of the courts in that jurisdiction for disputes arising out of these Terms.
